Motor third party liability insurance is a mandatory type of insurance that, in the event of a traffic accident, covers the damage caused to the other party. In addition to the cover provided by the law, you can add any additional covers that suit you the best. This way, you can create insurance that is tailored to your needs.

The Motor Insurance Act guarantees compensation for damage to the injured party to the extent of the provisions of the Law of Obligations Act, taking into account the differences provided for in the Motor Insurance Act.

We pay indemnity if, due to a traffic accident, the driver has developed a permanent disability or the accident has caused the death of the driver. The sum insured for death is EUR 10,000 and the sum insured for permanent disability is EUR 20,000.

- The service provided by the repair shop turns out to be of poor quality and the repair company is unwilling to fix this.
- Recovery of damage caused by a pothole from the owner of the road.
- Damage is caused to the car at the car wash and the manager is not willing to compensate for it.
- Snow or ice falls on the vehicle from the roof of the building, and the owner of the building is not willing to compensate for the damage.
- A new car, for which you have entered into legal assistance insurance cover in addition to motor third party liability insurance within 7 days of purchase, reveals defects that the seller had concealed.
- The buyer of the vehicle you sold, which had additional legal assistance insurance cover at the time of sale, requests that the alleged defects of the vehicle be corrected.
- As a result of an accident, you have suffered proven damage that the motor third party liability insurance of the person who caused the damage does not have to compensate and the person who caused the damage is not ready to compensate.

Principles of historical loss accounting
The insurance and loss history of the owner or responsible user of the vehicle affects the formation of the motor third party liability insurance payment: the longer the insurance history and the fewer cases caused, the lower the risk assessment. In order to calculate the loss history of a foreign country, submit a certificate of the history of claims issued by the motor third party liability insurance fund of the respective country. In addition, the price of motor third party liability insurance is influenced by general statistics on traffic damage, the area of use of the vehicle, vehicle parameters (capacity, permissible maximum mass), the type of vehicle (e.g., passenger car, motorcycle), and the area of use of the vehicle (e.g., normal use, taxi, rental car).

Motor third party liability insurance premium is the result of a combination of several components:

If the damage has been caused in such a way that the person who caused the damage is unknown (not seen), it should be dealt with immediately and options should be explored to help identify the possible perpetrator, e.g. checking the parking security cameras, looking for witnesses, etc.
Yes, a moped has to have motor third party liability insurance.

Injuries to a vehicle caused by a collision with an animal are not covered by motor third party liability insurance. A collision with an animal is a traffic accident and compensation is paid for personal injuries. The additional coverage of the moose insurance helps in the event of a collision with a large animal. In that case, we will reimburse up to EUR 6,000 according to the terms and conditions. If you have an expensive vehicle, it is also worth taking out our comprehensive insurance.
Of the additional coverages of ERGO’s motor third party liability insurance, only the Moose MoD has a deductible, which is EUR 200.

- If people have been injured as a result of a traffic accident, then give first aid to the victims and call an ambulance.
- If the parties involved in the traffic accident cannot agree on the culpability, the police must be called to the scene.
- If there are no injuries and the parties agree on the party who caused the accident, the accident must be documented at the scene. We recommend you use the convenient digital form on avarii.ee which you can fill in on your phone. If you want to write by hand on paper, you can use the form ‘traffic accident report’ or write on a blank piece of paper. The report must include details of the vehicles involved (registration plate, make and model), the drivers, the owners (personal identification number, names, addresses, contact details) and the insurer, as well as a diagram of the accident. Make sure that the person who caused the damage confirms their liability for causing the damage with their signature.
- If possible, take pictures of the scene and the vehicles involved in the accident.
- To report a traffic accident, contact ERGO or the insurance company of the person who caused the accident as soon as possible.
- For passenger cars and motorcycles with the ERGO motor third party liability insurance policy, the Traffic+ towing service is free of charge. It will assist in towing the damaged vehicle from the accident scene to the nearest repair shop or parking facility in the event of a motor insurance claim. Since 2015, the law allows you to turn to your own insurance company in the event of a motor third party liability insurance claim. So, no matter where the person who caused the accident is insured, you as the injured party, always have the option of dealing with ERGO.
According to the amendment to the Motor Insurance Act that entered into force on 01.12.2024, motor third party liability insurance must be taken out for a vehicle that is not registered in the road register and whose design speed exceeds 25 km/h, or for a vehicle whose design speed exceeds 14 km/h and whose mass, fully laden, without load and driver, exceeds 25 kg. For example, such a vehicle may be a mini-moped, a larger electric scooter or a small tractor if you use it on public roads.
